Las pautas de actuación proporcionadas a las compañías farmacéuticas a través de las observaciones incluidas en las reuniones científico-profesionales se fundamentan en lo dispuesto en los Artículos 88, 94 y 95 de la Directiva Europea 2001/83/CE y los Artículos 7 y 18 del Real Decreto 1416/1994 relativos a la publicidad de los medicamentos de uso humano.
Asimismo, se basan también en lo establecido en materia de hospitalidad y reuniones en el artículo 11 del Código (Reuniones científicas y profesionales), las normas complementarias del citado precepto, el Anexo V del Código Consultas (Preguntas y Respuestas) y la Circular USD/02/14 (“Criterios de utilización de hoteles aplicables a las compañías farmacéuticas”).
Ante la necesidad e interés de las compañías farmacéuticas sujetas al Sistema de Autorregulación de conocer, con un mínimo de antelación, con seguridad y certeza, la posibilidad de colaborar/participar en una actividad de carácter científico profesional, se establecen con carácter general los siguientes criterios:
- REUNIONES NACIONALES: UN MES ANTES DEL INICIO deberá estar disponible públicamente toda la información relacionada con la actividad, sin que la misma incluya elementos que por resultar contrarios al Código, imposibiliten la colaboración/participación de las compañías farmacéuticas.
- REUNIONES INTERNACIONALES: DOS MESES ANTES DEL INICIO deberá estar disponible públicamente toda la información relacionada con la actividad, sin que la misma incluya elementos que por resultar contrarios al Código, imposibiliten la colaboración/participación de las compañías farmacéuticas.
El incumplimiento o inobservancia de este requisito implicará que la actividad sea clasificada como NO PROCEDE LA PARTICIPACIÓN por parte de la industria (color rojo).

Observations Index
The guidelines issued to pharmaceutical companies through the observations included in meetings are consistent with Articles 88, 94 and 95 of the European Directive 2001/83/CE and Articles 7 and 18 of the Royal Decree 1416/1994 relative to publicity of medicines for human use.
In the same way, they are also consistent with provisions established regarding hospitality and meetings in (i) article 11 of the Code, (ii) the Supplementary Rules of the mentioned provision, (iii) Annex II of the Code, Queries (Q&As), (iv) and Circular USD/02/14 (“Criteria Applicable to Pharmaceutical Companies on Hotel Use").
Given the need and interest of pharmaceutical companies to know in advance (meaning within a minimum time frame and with certainty and assurance) the possibility of collaborating/participating in educational scientific meetings, the following general criteria shall apply:
- NATIONAL MEETINGS: all information related to the meeting must be made publicly available at least ONE MONTH before it takes place, making sure that no elements nor aspects that could be understood as going against the Code are included, thus impeding pharmaceutical companies’ collaboration/participation.
- INTERNATIONAL MEETINGS: all information related to the meeting must be made publicly available at least TWO MONTHS before it takes place, making sure that no elements nor aspects that could be understood as going against the Code are included, thus impeding pharmaceutical companies’ collaboration/participation.
Infringement or failure to observe this requirement will result in the activity being classified as PARTICIPATION NOT PERMITTED by the pharmaceutical industry (in red).
