Complaint Procedure (Committee)
The complaints issued by the Surveillance Unit or by a company subject to the Code shall be addressed to the Secretariat of the Code of Practice Committee for their processing, whereas those issued by a third party not subject to the Code shall be addressed directly to the Jury of the Association for Self-Regulation of Commercial Communications (Jury of Autocontrol).
For further information with regard to the minimal formal requirements the complaint must comply with consult Article 32.2 Complaint Procedure.
See below a graphic representation, within the complaint procedure, of the mediation stage carried out before the representatives of the Code of Practice Committee. It is only applicable to the complaints issued by the Surveillance Unit or a pharmaceutical company.
The Committee shall mediate among the parts (claimant and defendant). If an agreement is reached, the complaint issued shall be resolved, signed and published in the self-regulation system website, unless exceptionally the Code of Practice Committee considers it necessary to preserve its confidentiality.
If the agreement were not possible, the Secretariat of the Committee shall transfer the record to the Jury of Autocontrol.
