Guidelines by the FSA Board of Management pursuant to Section 6 Subsection 2 of the FSA Code of Conduct for Interaction with Healthcare Professionals

6. Guideline pursuant to Section 6 Subsection 2 in connection with Section 20 Subsection 11 for interpretation of the terms ""reasonable hospitality arrangements"" (Section 20 Subsection 2 Sentence 2) and ""reasonable bounds for accommodation and hospitality"" (Section 20 Subsection 3 Sentence 1)

According to Section 20 Subsection 2 Sentence 2 a ""reasonable hospitality arrangement"" may be provided to participants of in-house training events. Moreover, pursuant to Section 20 Subsection 3 Sentence 1, ""accommodation and hospitality"" may not exceed ""reasonable bounds"".

6.1 The ""hospitality arrangement"" is ""reasonable"" and does not exceed ""reasonable bounds"" as long as it is socially acceptable. An amount of roughly EUR 60.00 is a benchmark for what is still considered a reasonable hospitality arrangement in Germany, under consideration of price increases and the value-added tax increase since the Code of Conduct took effect in 2004 (effective: July 2008).

ORDINANCE ON ARTICLES 7 AND 8 COC:

The assumption of costs for board at events within the meaning of Article 7 CoC and/or at business dinners for the purpose of exchanging information within the meaning of Article 8.2 f) CoC shall be deemed appropriate in any case if the cost is lower than EUR 75.00 per person and meal (including taxes and/or charges and tips).

Any assumption of costs for board at events within the meaning of Article 7 CoC and/or at business dinners for the purpose of exchanging information within the meaning of Article 8.2 f) CoC held abroad, the code of the country where board is supplied is applicable. In the absence of pertinent provisions abroad, the relevant provision of the CoC shall apply.

GUIDELINES REGARDING THE VALUE OF MEALS OFFERED TO HEALTHCARE PROFESSIONALS DURING SCIENTIFIC EVENTS

In accordance with article 31, 2bis, of the pharma.be Code of deontology, the value of the meals provided, drinks included, may under no circumstances exceed the limits as laid down. These limits are as follows:

A. For events that take place over several successive days, including the related hospitality, which according to article 72 of the Code are subject to a visa procedure:

- The value of a lunch, drinks included, may not exceed 40 euros.

- The value of a dinner, drinks included, may not exceed 80 euros.

B. For events that take place during one day only and that are not subject to a visa procedure:

- The value of the meals may not exceed 40 euros per lunch and 75 euros per dinner, all included (drinks, tax, room hire, etc.), at the market price.

- The maximum hospitality of 40 euros (lunch) + 75 euros (dinner) can only be offered if the programme includes at least six hours of scientific activities.

BULGARIA

9.4 Hospitality offered in connection with promotional, professional or other scientific events, shall be limited to travel, meal, accommodation and registration fees. The cost of a single offering of food and beverages to a healthcare professional cannot exceed the equivalent of 100 Levs including VAT. Outside the

territory of Bulgaria, the monetary threshold set in the country where the event takes place (i.e. the host country) shall prevail.

19.9. All promotional, scientific or professional meetings, conferences, congresses, symposia and other similar Events, or each particular Event organised or carried out with the sponsorship of a company, must take place in a proper establishment, which contributes to the main purpose of the Event and offers hospitality, only in accordance with the regulations of any applicable code(s). For the purposes of this section the words ‘’proper establishment’’ shall not include extravagant establishments, namely: with a reputation for being the best venue or hotel in the country or town, but shall include reasonable establishments, namely: those which Healthcare Professionals would be willing to pay for personal purposes or appropriate establishments, namely those: with standard hotel meeting rooms, conference centres, hospital or clinic premises; and in any case, a €70 threshold per person per meal applies for Events and congresses held locally (excluding taxes and tips). Accommodation threshold for local hospitality is €250 per night. For Events and congresses held internationally, the list of daily thresholds applicable per city/country should be followed according to the country’s local industry association and if no reference is made therein, a €90 threshold applies per person per meal.

Updated Articel 14 iv. effective 30 June 2014. Hospitality in line with the Art. 11.2. of this Code may be provided to Healthcare Professionals at sponsored Events. In case of International Meetings, any Hospitality extended shall be made in accordance with the rules of the jurisdiction in which the International Events takes place.

The Danish Ethical Rules for Promotion of Medicinal Products towards Healthcare Professionals (Jan 2014)

Section 13.08. Companies are not allowed to give or offer meals (food and beverages) to healthcare professionals except in cases where the value of such is not above one of the following monetary thresholds: Lunch DKK 400, dinner DKK 700 or meals at all-day meetings /conferences etc. DKK 1,200 (food and beverages). The monetary thresholds cover meals taken in Denmark, when providing meals in other European countries, the monetary thresholds set by the pharmaceutical industry associations in these countries must be complied with.

9.1 Hospitality

Hospitality offered to healthcare professionals should always be appropriate, secondary to the educational content and in proportion to the respective event. Hospitality offered in the form of meals should be limited to the amount of € 75 per the main course (lunch/dinner), € 100 for an all-day meal in the Slovak Republic and the amount of € 100 for the main course abroad.

11. SCIENTIFIC AND PROFESSIONAL MEETINGS5

11.1. ....In all cases, a maximum cost of 60 Euro (including taxes) per guest applies for any form of hospitality associated with meals. Payment for a meal that costs more than the maximum threshold mentioned above will be considered a breach of the Code. For Events that take place outside of Spain, the maximum threshold established by the National Association of the country where the Event occurs will apply. Therefore, for hospitality offered outside of Spain involving meals, the general rule provided for in article 19.4 (“If there is a conflict between rules of the different applicable codes for a given activity, the most strict or restrictive rule will apply"") will not be applicable.

Section 9.06. All forms of hospitality offered to healthcare professionals shall be “reasonable” in level and strictly limited to the main purpose of the event. As a general rule, the hospitality provided must not exceed what healthcare professional recipients would normally be prepared to pay for themselves. Any meals (food and beverages) shall not be provided or offered to healthcare professionals, unless, in each case, the value of such meals (food and beverages) does not exceed the monetary threshold of 80 euros per person including VAT. The monetary threshold for meals (food and beverages) outside of Estonia is the threshold set by the country. Enterprises should avoid using venues that are “renowned” for their entertainment facilities or that are “extravagant”.

Business meals with HCPs

It is permitted to organise business meals outside the scope of scientific events in areas appropriate for the purpose of the meeting. In any case, the daily cost per meal cannot exceed EUR 70, including VAT.

The cost of meals per participant should not exceed EUR 70 (excluding VAT) per day abroad and EUR 70 (including VAT) per day in Greece. The same cost of meal applies also for foreign HCPs who participate in scientific events held in Greece.

Sub-section 6.4.8 – Hospitality within reasonable bounds at manifestations

If a meeting does not fall into any of the three categories described in sub-section 6.4.5, it is deemed to be a manifestation, provided that there is a programme that provides for a need for information amongst healthcare professionals (see the decisions 11.042, A13.063 and A13.068). After the amendment of the Inducements Medicines Act Policy Rules (Beleidsregels gunstbetoon Geneesmiddelenwet) as of 1 February 2012, the sums for hospitality at manifestations have been increased to a maximum of €75 per occasion and €225 per year.

8. 'inexpensive gift' shall mean any benefit provided in kind whose value including value added tax, or failing this, its purchase price or production cost including value added tax is less than 5 per cent of the prevailing monthly minimum wage;

9. 'reasonable support' shall mean any support where the costs of the event per person does not exceed the amount specified in Point 8;

Section 14.

(2) Entertainment and hospitality functions may be arranged for the promotion of medicinal products and medical aids solely for professional, scientific and educational reasons. The daily amount spent on such entertainment and hospitality functions by promoters of medicinal products and medical sales representatives may not exceed the limit specified in Point 8 of Section 3 and shall remain subordinate to the main objective of the meeting. Only healthcare professionals and persons engaged in the supply and distribution of medicinal products and/or medical aids may be invited to such trade and promotional events and demonstrations.

Update 08-12-2014: The 4TAs’ Ethical Committees have requested clear guidance on what rules apply for each event type based on the current legislation. This work is in progress.

16.3 Companies shall not provide or offer any meals to healthcare professionals, unless, in each case (i.e. per meal and per recipient), the value of such meals (food and/or beverages) does not exceed the current monetary threshold set by IPHA of €80 (including VAT and excluding gratuity). It should be remembered that this threshold is in addition to the existing restrictions on hospitality (reasonable, secondary to the main purpose and in compliance with all other aspects of the Code) and only applies to events in Ireland. Where the hospitality occurs in another member state bound by the EFPIA Code the hospitality threshold set in that member state will apply.

During the days of the congress the hospitality offered may also include meals and drinks up to a threshold of 60 Euro per each Professional per meal for all events in Italy. As for events held abroad, referral shall be made to the amounts and thresholds mentioned in the relative country’s Code of Professional Conduct, where applicable. In any other case, the limit remains fixed at 60 Euro also for events held abroad. The respect of the principle of sobriety shall, however, be guaranteed and the meal shall be offered preferably in the same hotel where the guests are staying or in contiguous structures.

Section V. Hospitality allowances

10. The following hospitality allowances may be offered in Latvia:

10.2. catering. Maximum amount per person per one meal (food and drinks) shall not exceed EUR 60, and the total maximum amount per all meals per day shall not exceed EUR 100 in Latvia; 12. It is allowed to make the following payments related to an international event (an event held abroad): 12.5. Catering. The Pharmaceutical Company can chose to apply standards/limits valid for the country where the event is held, or the maximum amount of costs provided in the Sub-paragraph 10.2 hereof. For catering expenses, the Pharmaceutical Company shall apply norms/limits valid for the country where the event is held (e.g. the monetary threshold defined in the “host country”).

10.05. Pharmaceutical Companies shall not provide or offer any meal (food and beverages) to healthcare professionals, unless, in each case, the value of such meal (food and beverages) does not exceed the monetary threshold set by the relevant Implementation Rules of the Code of Practice on the Promotion. The governing monetary threshold is the one set in the country where the event is held (e.g. in the “host country”).

Section 10.05. Member Companies shall not provide or offer any meals (food and beverages) to healthcare professionals, unless, in each case, the value of such meals (food and beverages) does not exceed the monetary threshold of €60 per HCP set by the PRIMA code.

Reasonable hospitality should be limited to the main scientific objective of an event and restricted to the healthcare professional for the duration of the event, and not extended beyond 24 hours from commencement or adjournment of event subject to flight availability. It must not be extended to persons other than health care professionals. Hospitality during local events should not exceed €60 per HCP.

9.04 Cost coverage

Hospitality in connection with arrangements shall be limited to travel, meals and overnight accommodation. Any necessary attendance fees may also be paid.

All types of hospitality offered to healthcare professionals shall be of a reasonable scope and level, and shall be a necessary premise for the professional programme. As a general rule, it shall not exceed what healthcare professionals would have paid if they were to pay it themselves. The following also apply:

a. For dinner and lunch, the rates which are currently established by LMI's Board of Directors shall not be exceeded. These rates are established for dinner at 70 % of the State's representation rates (currently NOK 822) and for lunch at 40 % of the State's representation rates (currently NOK 172) for meals at medical offices.

b. For events outside Norway, the established maximum amount in the event's host country shall prevail.

c. Alcoholic beverages shall not be served, apart from beer and wine with meals.

d. There shall be at least 5 hours per day of professional programme. On travel days there shall be three hours of programme insofar as this is feasible.

e. Arrangements may not be made for tickets to be used wholly or partly for holiday purposes.

f. The company is obliged to specify what costs are covered.

g. Companies shall maintain records of their activities. The records shall contain the complete professional and non-professional programme, as well as a specification of what activities are covered. The records must be set up in conformity with a form prepared by the Committee for Information on Medicinal Products. This information must be kept by the company for a period of two years after the event took place. The Committee may demand access to the records.

Clause 19.2 Maximum Cost of a Meal

The maximum of £75 plus VAT and gratuities is appropriate only in very exceptional circumstances, such as a dinner at a residential meeting for senior consultants or a dinner at a learned society conference with substantial educational content. The cost of a meal (including drinks) should normally be well below this figure. The requirements relating to hospitality in Clause 19.1 and its supplementary information still apply.

The maximum of £75 plus VAT and gratuities (or local equivalent) does not apply when a meeting is held outside the UK in a european country where the national association is a member of EFPIA and thus covered by EFPIA Codes. 3. Limit for hospitality in the Czech Republic

Hospitality offered or provided to healthcare professionals in connection with the promotion or meetings in the Czech Republic must not exceed the amount of CZK 3000 (VAT included) per HCP per one day for food and beverages (maximum 1500 CZE per one lunch and 1500 CZE per one dinner) The maximum hospitality can be offered only if the programme includes at least 6 hours of scientific activities. If the programme includes less than 6 hours of scientific activities the limit must not exceed the amount of CZK 1500 for hospitality.

4. Limit for hospitality provided abroad

Hospitality offered or provided to healthcare professionals in connection with the promotion or meetings abroad must not exceed the amount of € 150 (VAT included), respectively equivalent in the relevant foreign currency, per HCP per one day for food and beverages (maximum € 75 per one lunch and € 75 per one dinner). The maximum hospitality can be offered only if the programme includes at least 6 hours of scientific activities. If the programme includes less than 6 hours of scientific activities the limit must not exceed the amount of € 75 for hospitality.

5. Common and final provisions

If a different limit for hospitality is valid abroad (determined by generally binding legal regulations or ethical codes of the local association), the AIFP member company shall respect the local limit. If no limit for hospitality is valid abroad the AIFP member company shall respect the limits set by the AIFP for hospitality provided abroad.

Section 10.11. The maximum limits for hospitality expenses are:

c) Meals: for domestic meals, the maximum limit is RON 300* (three hundred RON) per day for every person (coffee-break included), when the hospitality includes lunch, dinner and coffee-breaks or RON 150* (one hundred fifty RON) per person, when the hospitality includes only one main meal.

For meals abroad the maximum limit is 150* EUR (one hundred fifty) / day (or the relevant equivalent) for lunch plus dinner.

This limit does not apply for „gala dinner” organized as part of the international congresses (as described in the documentation of the event).

ARPIM member companies shall not provide or offer any meal (food and beverages) to healthcare professionals, unless the value of such meal (food and beverages) complies with the monetary threshold set hereby.

Q&A clarifies: For the purposes of p. 3.3.6 of the Code, the term ""reasonable limits"" refers to the average cost of meals at events of such type (taking into account the duration of an event and number of participants) conducted by pharmaceutical companies in a particular region or in the whole country. AIPM member companies should have specific cost limits set by their internal documents.

8.6.2 Limits of Hospitality:

Hospitality should be limited to refreshments and/or meals incidental to the main purpose of the Event and should only be provided: (i) to participants of the Event and not their guests; and (ii) if it is moderate and reasonable as judged by local standards. As a general rule, the hospitality provided should not exceed what HCP recipients would normally be prepared to pay for themselves. APRAD establishes the following thresholds for meals and refreshments: (i) 300 UAH per meal per a HCP and the overal hospitality expenses per day should not exceed 570 UAH (for non-personalised meals during conferences, seminars, etc.); (ii) up to 800 UAH per meal for an individual interaction when a contract between a company and HCP is concluded or in line with the current Ukrainian legislation.
