CHAPTER V – Rules of application, Monitoring, Breaches and Sanctions
20.1. Companies subject to the Code provisions in accordance with articles 19.1 and 19.3 may submit queries on the application of the Code for a given activity or request clarification of a more general nature in relation to the Code. Queries related to the content of specific promotional material are excluded.
20.2. Queries must be addressed to the Code of Practice Surveillance Unit according to the procedure established for this purpose in Title II Rules of Procedure for the Control Bodies and must be resolved by the Code of Practice Committee. Queries will be binding for the Code of Practice Surveillance Unit and the Code of Practice Committee.
20.3. Neither the queries nor the result may be mentioned in promotional activities or in the interactions with Healthcare Professionals or Patient Organizations.
20.4. Queries of general interest to the sector as a whole may be published at the discretion of the Executive Board in the form of questions and answers, respecting the anonymity of the company that made the query (Annex III).
